These general conditions of sale (hereinafter, the "General Conditions") are valid exclusively between the company Industries S.p.A. (hereinafter, the "Seller" or the “Company”) and the subjects (hereinafter, the "Customers") who will make purchases on the occasion of the extraordinary sale to be held from April 1st, 2021 to May 15th 2021 at the dedicated website moncler.com (hereinafter, the "Sale"). All purchases are subject to compliance with these General Conditions. Being the website currently in testing phase, the Seller cannot warrant that the website will operate continuously, without any interruptions and/or that errors or defects will be corrected immediately. Customer therefore acknowledges and agrees that the Seller will not be liable for any interruption, error or malfunctioning of the website during the Sale. In case of problem, Customer could contact Moncler Client Service.
1. OBJECT OF THE EXTRAORDINARY SALE AND PRICES APPLIED
1.1. The Sale will concern accessories, clothing, shoes and gifts bearing the Moncler trademark (including both Genius and non-Genius collections) relating to the Spring/Summer 18 season, which have remained unsold (the "Products").
1.2. Given the provisions of the previous art. 1.1, the prices of the Products are offered on sale to Guests, as hereinafter defined, at 50% (fiftypercent) compared to those prices normally practiced in the ordinary sales network and the discount of 65% (sixtyfive percent) is applicable to the employees of the Company through a dedicated voucher (up to 3 redemptions).
2. ACCESS TO THE SALE
2.1. Access to the Sale is reserved for Company employees who have received an individual invitation by email and who are holders of a valid employment contract in force on the date of the Sale (the "Employees"), as well as third parties unrelated to the Company who have received an invitation from an Employee (up to five per Employee), provided that they have been previously indicated to the Seller by the Employees before the Sale takes place (the "Guests").
2.2. Employees and Guests will be identified upon registration with the dedicated website, upon compilation of a dedicated form with the following information: first name, last name and email address.
2.3. For the exclusive purposes of the Sale, temporary workers who, at the time of carrying out the Sale, are employed by the Company will also be considered as Employees.
2.4. Access to the Sale is subject to the prior acceptance of these General Conditions, which will be available on the dedicated website during the Sale.
3. PAYMENT METHODS AND PURCHASE LIMITS
3.1. The following payment methods are accepted: debit and credit cards (VISA, MASTERCARD, JCB, AMEX, DISCOVER, UNION PAY), digital wallets (PayPal, Google Pay), express payments (Apple Pay).
3.2. The Products purchased are intended for personal use only, therefore any resale is strictly prohibited.
3.3. In order to allow all customers to participate in the Sale at equal terms and to be able to enjoy the widest possible range of products, the Sale is subject to purchase limits indicated below:
● Maximum of 2 SKU per item;
● Maximum of 10 items per checkout;
● Maximum of 4 Genius Outerwear items; and
● Maximum of 6 Outerwear items of non-Genius collections.
4. STATE OF PRODUCTS - EXCHANGES AND REFUNDS - CANCELLATION OF ALL RIGHTS AND WARRANTIES
4.1. Given the nature of the Sale as described in articles 1.1 and 1.2 above, the following conditions apply:
4.1.1. Exchanges and returns of purchased Products are allowed. For details on return and exchange terms, please read our Return & Exchange policy here;
4.1.2.The Sale and therefore the purchase takes place in the actual state of the Products at the time of the Sale. Moreover, it is important to highlight that the Products belong to the outlet channel.
5. PRIVACY
5.1. Personal data are collected exclusively for the purpose of carrying out the Sale as well as to prevent unauthorized persons from having access to the Sale itself.
5.2. Personal data will not be processed for marketing or profiling purposes, unless participants to the Sale do give their specific consents to these purposes of data processing when registering with the dedicated website according to Article 2.2. above and accepting relating privacy policy.
6. APPLICABLE LAW AND JURISDICTION
6.1. The Sale, purchases and these General Conditions are governed by Italian law. As a consumer the purchaser will in any case be entitled to any additional rights provided by the law of the country where he/she resides. Either the customer or the Company may bring legal actions in respect of any dispute which arises in connection with the purchase contract only in the court of Milan (Italy) or the competent court of consumer’s habitual place of residence or domicile, as applicable.
